Design Review Guidelines

 

A.  Introduction

            The value of each of the 37 Mayfair of McLean Association (MoMA) properties is inextricably linked to the quality, integrity, and uniformity of its environment.  TO that end, the Design Review Guidelines have been established as a guide for present and future owners to safeguard Mayfair’s environment, to avoid disputes and the enhance property values.  While neighboring Association have more detailed standards, the MoMA Board of Directors has tried to leave much to the common interests of property owners and to limit the Board’s formal involvement. 

 

            The Design Review Committee (DRC) is established in accordance with Section 6.1 of the Mayfair of McLean Association By-Laws.  The Board of Directors appoints a DRC consisting of three or more persons, which carry out the review functions and development of guidelines set forth in Article VII of the Declaration. 

 

            The Design Review Guidelines promulgated hereunder are intended to assist the DRC and the Owners of Lots in the ongoing process of environmental design and use, and as such may be modified and supplemented from time to time, on due notice to the Owners and subject to approval of the Board of Directors of the Association. Note that nothing herein changes, alters, or amends anything contained in the Declaration of Covenants, Conditions, and Restrictions nor does it alter or amend any rights or obligations of any member pursuant to any valid and enforceable rule, regulation, or law of the Commonwealth of Virginia or any of its subdivisions,

Furthermore, notwithstanding any provision herein, a member may seek a good faith exception to any such provision herein upon an application  stating the provision for which the exception is sought, the specific exception sought, and the good faith basis for the requested exception.

 

A.1.     Design Review Guidelines

            This document establishes the Mayfair of McLean Association (MoMA) Design Review Guidelines for use by owners, and provides sufficient information for owners to prepare a complete Architectural Review Application.  It also provides the philosophy, specific standards and guidelines for owners to develop plans, and designs for exterior changes to their property.  This document also describes the organizations and procedures of the architectural review and enforcement process.  The intent of this document is to increase owners’ and residents’ awareness of their responsibilities in the architectural review process.

 

            Enforcement of the Design Review Guidelines ensures owners and residents that design and aesthetic quality will be maintained, thereby enhancing property values and the community’s overall appearance and environment.  Architectural Standard applies to all Mayfair of McLean Lots and Association members.  The DRC is charges with enforcing these standards. 

 

A.2      Standards Review

            The MoMA Design Review Guidelines are to be formally reviewed no less frequently than every five years.  Upon completion of the review process, recommendations for revisions will be sent to the Board of Directors.  When the Board approves the final draft, the document is then published and made available to owners and residents.  If the need to revise any part of the MoMA Design Review Guidelines occurs between scheduled reviews, upon review and approval by the Board, subsequent revisions become part of the Standards and will be made available to the owners and residents.

 

 

B.  Philosophy

B.1.     A Sense of Community

            One of the most important functions of these Design Review Guidelines is to maintain and enhance the aesthetic quality and design of the homes, other structures, and environment within MoMA.  This is supported by maintaining a sense of community beginning with the individual’s property and ending with the community at large.  The MoMA Board of Directors appoints members to serve on the DRC.

 

B.2.     Process

            When the DRC reviews an application to modify a property, it considers the effect the modification will have on the following four levels:

1.     The property (dwelling and grounds).  If okay, the DRC next considers…

2.     The adjacent properties (next to and across from), if okay, the DRC next considers…

3.     The immediate neighborhood.  If okay, the DRC next considers…

4.     The MoMA community at large.  If it appears the modification will be compatible with the property, adjacent neighbors, and the MoMA community, the DRC will approve the application.

 

B.3.     Tree and Landscape Management

            The intent of the MoMA Design Review Guidelines is to create a complimentary relationship between development and nature’s beauty.  Trees and the common areas are significant contributors to that relationship.  Under an integrated land management plan, the BOD and the DRC considers an owner’s property in relationship to the rest of the community, rather than solely individual components of the property.  This embodies the protection and preservation of trees, while considering their effect on the entire landscape of the property and surrounding community.

 

            MoMA’s tree policy sets forth the community’s tree policies and the responsibilities of the home owners/resident and the DRC with regard to removal of trees in open space areas.

 

Tree Policy:

The MoMA will not remove limbs from trees extending over private property.  It is the responsibility of homeowners to protect their own property.  Homeowners have the right to remove limbs that extend over their property lines at their cost.  It is also the responsibility of homeowners to notify the MoMA and DRC of any trees that appear ready to fall or otherwise need immediate attention.  Homeowners may not remove trees outside their property lines.

 

Homeowners have a right to remove segments of tree limbs (from open space or from an adjacent property) that extends over their property line, but they need to do so without jeopardizing the health of the tree.  No more than 25% of a tree may be removed.  If excessive trimming is done, resulting in permanent disfigurement or death of the tree, the homeowner may be held liable for replacement of the tree.  The homeowner may not trim beyond their property line unless granted written permission by the property owner.

 

            Residents should note that trees with the trunk/bases within 10 feet of a dwelling that create a negative effect on use of the dwelling and surroundings may be considered for removal; and trees whose branches stretch across decks and roofs, causing a natural flow of leaves and/or flowerings to fall into the yard and/or gutter system are not considered disruptive or a nuisance.  All other conditions must be considered on a case-by-case basis.

 

            An application is required for removing any standing tree, dead or alive, that measures four or more inches in diameter; measured at a height of twelve inches above grade.  When needed, an arborist’s fee made payable to Mayfair of McLean Association will accompany this application.  This is to pay a registered arborist or forester to determine the necessity/advisability of tree removal, should the DRC feel unqualified to approve or recommend disapproval of the requested removal.

 

B.4.     Synthetic Materials

            Current technology has produced synthetic or composite materials that are intended to replicate wood, or manmade materials.  Synthetic materials may be approved after an appropriate application, if they replicate original materials in terms of color, texture, architectural appearance/style, dimension and overall appearance. 

 

B.5.     Emergency Repairs

            When required by unforeseen circumstances (e.g., weather, car accident, etc.) homeowners are responsible for the timely remedy of safety hazards (e.g., tree removal, roof repair, etc.) even it these standards require an application for such remedy.  When a remedy is an immediate requirement (for safety of individual, community and/or property), homeowners fixing the hazard prior to DRC approval should document the hazard and the remedy, and then submit an application to the DRC.  These applications will go through the standard process.  Submittal is not DRC approval.

 

 

C.  Key Participants in the Design Review Process

C.1.     Association Members

            Each owner within MoMA is a member, and has a direct and important role in the DRC process.  The member’s role is ensuring the property is maintained, being knowledgeable of the Design Review Guidelines, and participating in the DRC review process on an individual or a volunteer basis.

 

C.2.     Improvement or Change within the Common Areas

            Any natural or artificial material installed or changed on the MoMA common space must have the approval of the Board based on the recommendation of the DRC.  Nothing shall be installed or changed to any lot or area that encroaches upon the common space.  No part of the common space may be put to the exclusive use of fewer than all MoMA members without the prior, expressed written consent of the Board.  The Board will consider any request for changes to the common space after review by the DRC, and a determination made with respect to the best interests of the MoMA as a whole. 

 

 

D.  Design Review Committee

            Duties of the Design Review Committee include but are not limited to regulating the external design and appearance and improvements to the property.  Prior to the annual meeting, a DRC member visits each property. 

 

            The Design Review Guidelines promulgated hereunder are intended to assist the DRC and the Owners of Lots in the ongoing process of environmental design and use, and as such may be modified and supplemented from time to time, on due notice to the Owners and subject to approval of the Board of Directors of the Association.

 

            These Guidelines require prior DRC written approval for any change to the exterior appearance of one’s property or common area.  It is important to understand that the DRC approval requirement applies to all exterior alterations.  Repairs and maintenance that do not change exterior appearances (modification to the existing materials, style, color, texture, function or dimension) of the property do not require DRC approval, unless specifically required in these Standards.

 

D.1.     Declaration of Covenants, Conditions, and Restrictions - Article VII: Design Review

Section 1: The Design Review Committee (DRC):  A DRC consisting of three or more persons shall be appointed by the MoMA BOD.       

           

Section 2: Purpose: The DRC shall regulate the external design, appearance, use, location and maintenance of the Property and of improvement thereon in such a manner as to preserve and enhance values and to maintain a harmonious relationship among structures, vegetation and topography.

 

Section 3: Restriction Stated:  No building, fence, wall, residence, structure or projection from a structure (whether of a temporary or permanent nature and whether or not such structure shall be affixed to the ground) shall be commenced, erected, maintained, improved or altered. Nor shall any grading, excavation, landscaping, tree removal, planting, change of exterior color or other work which in any way alters the exterior appearance of any Lot or improvement thereon may be done without the prior written approval of the DRC.  The DRC approval will adhere to the philosophy outlined in this document. 

 

Section 5: Guidelines: The DRC shall, subject to the approval of the MoMA BOD, develop and promulgate guidelines procedures and standards for the application of the design review environmental use provisions set forth in the document. 

 

D.2.     Declaration of Covenants, Conditions, and Restrictions - Article V: Exterior Maintenance

Section 3: Maintenance of Lots: Each owner shall keep all improvements owned by him in good order and repair, such that the appearance of the Lot, in the opinion of the Board of Directors, is not detrimental to adjoining properties and is consistent with the maintenance standards in the Design Guidelines.

 

Section 5: Failure to Maintain or Restore: If an Owner fails to maintain his or her Lot of the improvements thereon in accordance with Section 3 or to restore improvements in accordance with Section 4, the Board of Directors, after affording the Owner an opportunity to be heard, may, upon a two-thirds vote, cause the necessary work to be performed and/or seek to obtain a mandatory injunction requiring the Owner to perform the necessary maintenance or restoration. 

 

D.3.     Appeals Board

            The Appeals Board, made up of the BOD, shall have the power and duty to:

1.     Decide appeals to decisions of the DRC; and

2.     Decide cases of alleged infraction of the governing documents; and thereupon compel action or enjoin action of parties found in violation of the governing documents; and

3.     The Appeals Board may act upon an appeal only upon written petition of the member or members and shall act in accordance with the Bylaws.  The BOD, upon its own motion, may reverse or modify a decision of the DRC. 

 

Criteria for Review: The function of the Appeals Board, when hearing an appeal is to review the DRC’s decision in light of the following criteria:

1.     The DRC followed proper procedures in reviewing the application.

2.     The applicant, directly affected party, or concerned party received fair consideration.

3.     The decision rendered by the DRC has a rational basis and was not arbitrary.

 

D.4.     DRC Responsibilities

1.     Within 30 days of submission to the DRC, review and approve, modify, and/or disapprove all written applications filed by owners and the MoMA for improvements and/or additions to lots, living units or common areas.

2.     Inspect the properties for compliance with Design Review Guidelines and guidelines and approved plans for activities outlined in Section 3 of the Declaration of Covenants, Conditions, and Restrictions.

3.     Adopt Design Review Guidelines and guidelines subject to the approval of the Board.

4.     Adopt procedures for the exercise of its duties.

5.     Maintain records of all actions taken.

6.     Enforce standards and make recommendation to the Board regarding continued violations of standards.

7.     Research and promote cost-effective products and materials that meet the philosophy of these Design Review Guidelines and positively influence the harmony of the MoMA community.

 

 

E.  General Criteria

The DRC is specifically charged with regulating the external appearance and location of property improvements.  The DRC specifically considers five architectural criteria when reviewing an application.

 

E.1.      Architectural Criteria

1.     Design: The proposed modification must be compatible with the architectural characteristics of the applicant’s home, adjoining homes, and neighborhood setting.  Design compatibility is defined as similarity in architectural style, workmanship, scale, materials (type, style, and dimension), and design and construction detail.  Applications for exterior modifications to a property are considered from the perspective of their being part of the entire structure.

 

2.     Color: Color must be consistent and provide continuity by using the same or compatible colors and color combinations as those used in the original construction of the home, surroundings and throughout the neighborhood.

 

3.     Location and Impact: The proposed improvement or modification must relate favorably to the landscape, the existing structure, adjoining property, and surrounding neighborhood.

 

4.     Workmanship: The modification must meet all Fairfax County Code Requirements and the applicant must secure all necessary permits.  The DRC will not knowingly approve a modification that does not comply with the Fairfax County building or zoning requirements (the DRC does not review an application for compliance with county standards).  The DRC requires the work to meet standard of workmanship, be completed on time as specified, be aesthetically acceptable, and require only normal maintenance.    The applicant is responsible for corrections, if needed.

 

5.     Timing: Timely completion of a project is necessary to minimize safety hazards and potential objectionable or nuisance situations.  All applicants must include estimated completion dates.  Alteration authority granted by the approved application will be revoked automatically if the alteration has not been completed within 180 days of the date of application was approved.  Changes to an approved modification, must be approved in accordance with the Bylaws.

 

 

F. Application Process

F.1.      Application Requirements

            An application is required for all modifications, as referenced in Section D above, to the exterior appearance of a Property within the MoMA.  An application may be found 1) in the back of the MoMA Design Review Guidelines, or 2) by requesting an application via Email from the DRC Chairperson.

 

F.2.      Application Completion and Assistance

            An application must be completed before it is processed by the DRC.  Once the application is deemed complete by the DRC, it will be considered “accepted” and start the 30-day timeline.  If incomplete, the missing information must be provided before the application may be accepted.

Read all the items listed.  Sign and date application.

 

 

 

 

F.5.      Review Process

            The DRC will render an opinion on the application within 30-days of an acceptable submittal.  The DRC shall inform the Applicant of any deficiencies in the Application within 30-days.   If the DRC fails to approve, modify, or disapprove in writing a correctly filed application that is completed and accepted within 30-days, approval will be deemed granted.

 

            The DRC will deliver the completed and accepted application to the requesting member, and keep a copy for its records.

 

            The DRC will attempt to conduct all reviews and approvals virtually, without meeting.  The paucity of members and the ease of electronic communications enable expediting the review and approval process.  If a member would like to address the DRC with information not providing in the Application, the member shall ask the members of the DRC to convene.  The member is responsible for inviting all affected Lots and members of the scheduled meeting.

 

            Applicants always have the opportunity to modify or withdraw the application.  Withdrawn applications may be updated and/or corrected as needed for future resubmission.

 

            When an application is disapproved, the DRC will notify the applicant of the disapproval and the reason according to the Design Review Guidelines criteria.  The applicant has twenty (20) calendar days from the date the application’s disapproved to file an appeal with the BOD by completing and delivering 1) the original application, 2) the DRC decision documents, and 3) the rationale for their appeal. 

 

 

G.  Mayfair of McLean Design Review Guidelines

            The following standards reflect the most frequently requested exterior modifications.  It is not an exhaustive list of possible changes to a MoMA property.  Any items not specifically addressed, requires the submission of an application and approval of the DRC.  The criteria in Section E apply to all standards formally listed herein and to any not yet identified. 

 

G.1.     Air Conditioners & Heat Pumps

            Requirement:

1.     An application is not required to replace a unit in the same location.

2.     An application and approval is required for adding any air conditioning unit (window, wall, roof or ground) or relocating an existing unit.

 

G.2.     Antennas, Television/Computer Cabling & Satellite Dishes

Requirement:

1.     An application is not required for satellite dishes less than one meter in diameter in the longest dimension of other multi-point media distribution systems antenna and multiple element dipole antennae. 

2.     An application and approval is required for all other antennae of any kind.

Standards:

1.     Satellite dish antennae, when ground mounted, should only be placed in the rear yard.

2.     All wiring or cabling shall be installed in a professional manner and routed along the natural edge lines of the dwelling (e.g., roof peaks, roof edges, side wall corners, overhang joints, soffit lines) and fastened to the structure at points no more than ten feet apart.

 

G.3.     Animals

Requirement:

1.     An application is not required for domestics animals maintained for the purpose of a pet.  Cats, dogs, caged birds or other similar animals kept as domestic pets and not for commercial breeding are allowed as long as they do not create a nuisance.

Standards:

1.     Owners/caregivers are responsible for cleaning up after pets.

 

G.4.     Attic Ventilation

Requirement:

1.     An application is not required to replace a vent in the same location and of similar size, color, and design provided that it meets the standards.

2.     An application and approval is required for the installation of a new gable vent, ridge vent, or roof vent.

Standards:

1.     Gable vents shall be louvered; shall be metal or wood; and shall be painted in accordance with the color of the brick.

2.     Roof Vents shall not extend more than four inches about the roof ridge line; shall be gray galvanized metal or stainless steel, painted black; a vent may also be copper. 

 

G.5      Awnings

Requirement:

1.     An application and approval is required for all awnings

Standards:

1.     Awnings shall be located only in the rear of the dwelling.

 

G.6      Barbecue Grills

Requirement:

1.     An application is not required for a portable barbecue grill.

2.     An application and approval is required for all permanent (built-in) barbecue grills.

3.     An application and approval is required for a permanent grill gas line.

Standards:

1.     Grill shall be located in the rear patio or on a deck.

2.     Any permanent fuel lines shall be concealed from view.

 

G.7.     Bird Houses, Baths, Feeders

            Requirement:

1.     Bird/bat house dimensions that do not exceed 12” x 12” x 18” are permitted in the rear of the property. 

2.     Birdbaths, not more than 30” in diameter or 36” in height, are permitted in the rear of the property.

Considerations:

1.     Birdfeeders are known to attract rodents that may carry disease and damage homes.  Care should be taken before introducing birdfeeders or birdhouses to the MoMA community due to these consequences.  Any pest infestation caused by bird feeders and/or birdhouses must be dealt with promptly by the owner to avoid any intervention by the Association.

 

G.8.     Chimneys, Caps, Flues, and Vents

Requirement:

1.     An application is not required to replace chimneys, flues or vents in the same location and of similar size, color, and design.  Installation of chimney caps that are grey galvanized metal or stainless steel and are painted black or a color to match the roof, or made of copper needs no application.

2.     An application and approval is required for the installation of new chimneys, flues or vents.

3.     All other new exterior venting, such as exterior dryer vents, stove exhaust venting, or gas venting require an application.

 

Standards:

1.     Chimney, flue, or vent style shall be appropriate for the dwelling and community.

2.     A color other than black or matching the roof and materials shall be compatible with the dwelling’s existing colors and materials.

3.     All external fuel lines shall be routed along natural-edge lines of the dwelling to minimize visual impact.

4.     Exterior vents shall be painted to match the exterior façade surrounding the vent, such as the siding, trim, brick or deck color.

 

G.9.     Clotheslines: Are Not Permitted

 

G.10    Decks

            Requirement:

1.     An application is not required to replace an existing deck in the same location and of same dimension and similar color and design as the one originally constructed on the Lot providing the standards are met. 

2.     An application and approval is required for all new deck or changes to existing decks including extension of the deck, change in materials and/or railing style, removal or color change.  Decks comprise decking, rails, stairs, support structure, and any other integral components.

3.     Decks shall be located in the rear property.

4.     All required County permits are required in advance of construction and are the responsibility of the owner.

Standards:

1.     Decks shall be constructed of pressure-treated wood, natural redwood or a comparable composite material.

2.     All fasteners must be rust resistant (galvanized, coated, or stainless steel).

3.     Decks shall be left to weather naturally, or stained with a natural wood tone (no Redwood stain).  Other earth tone semi-transparent wood stain colors will be considered on a case-by-case basis.

4.     Decks may not be painted unless the color is approved by the DRC.

5.     Wood composite decking materials which are natural wood tones will be considered on a case-by-case basis.

6.     Areas under the deck used for storage shall be screened with framed lattice, which is consistent in color with the decking or with appropriate vegetation.

7.     Corrugated panels installed under deck flooring require a DRC approval, and must be screened from view and be earth-tone color to blend with the decking material.

 

G.11    Decorative Objects

Requirements:

1.     All objects in the front of or adjacent to any dwelling require an application and approval with the exception of holiday decorations that are in place no longer than 30 days prior to and 30 days after a holiday.

2.     Exterior decorative objects include but are not limited to: sculptures, fountains, non-plastic flower pots, statuaries, ponds, and items attached to the dwelling such as holiday decorations.

Standards:

1.     Decorative objects shall be appropriately sized, and of a color and composition consistent with surrounding materials. 

2.     Window flower boxes are not permitted.

 

G.12.   Dog and/or Animal Houses

Requirement:

1.     An application and approval is required for all dog or animal houses

Standards:

1.     All doghouses and animal house are to be located in the rear yard and will be compatible with the color and design of the dwelling.

2.     Pens/runs are prohibited.

3.     No animal house will be used for feral cats or other wild animals.

 

G.13.   Doors - Entry

Requirement:

1.     An application is not required to replace entry doors in the same location with similar color and design provided the standards are met.

2.     An application and approval is required to replace any door that is different in appearance from the one being replaced.

Standards:

1.     The door design/style shall be compatible with the architecture of the dwelling.

2.     Front door with side panels that are compatible with the architectural style of the dwelling shall be considered on a case-by-case basis.

3.     Doors shall be compatible with the color scheme of the dwelling.

 

 

G.14.   Doors - Garage

Requirement:

1.     An application is not required for replacing garage doors that are the same dimension, color, and design.  An application and approval are required to replace garage doors with a different style, design or dimension from the above. 

Standards:

1.     Color of door(s) must be in compliance with the color scheme for the dwelling

2.     No ornamentation is allowed

3.     The door must have raised panels similar to all other doors in the community for the specific dwelling

 

G.15.   Doors - Storm

Requirement:

1.     An application is not required to replace storm doors in the same location with similar size, color and design

2.     An application and approval are required for all new or replacement storm doors that are dissimilar to the one being replaced.

Standards:

1.     Storm doors shall be full-view and compatible with the architectural style of the dwelling and the entry door.

2.     Storm doors shall match the color of the entry door, or the trim around the windows.

3.     Storm doors may not include decorative scrolling, mullions or bars installed on the inside of the door.  The architectural style of the door shall be compatible with the architecture of the dwelling.

 

G.16.   Drainage

Requirement:

1.     An application and approval is required for all alterations to storm water drainage on lots to be consistent with all applicable rules, regulations, and laws of the Commonwealth of Virginia.

 

G.17.   Driveways and Walkways – Mirror 15

Requirement:

1.     An application is not required to replace a driveway or walkway in the same location with similar materials, color and design provided the standards are met.

2.     An application and approval is required to replace any driveway or walkway that is different in appearance from the one being replaced.

Standards:

1.     A driveway shall be of the same material and design as the existing driveway.  Materials other than brick pavers will be considered on a case-by-case basis.

 

G.18.   Fences/Gates

Requirement:

1.     An application is not required to replace a fence/gate in the same location with similar materials, color and design provided the standards are met.

2.     An application and approval is required to replace a fence/gate that is different in appearance from the one being replaced.

3.     An application is not required for an invisible fencing system, providing all components and wiring are below grade and not visible, and there is no additional signage or markers, and the system is contained within the owner’s property. 

Standards:

1.     Gates shall be compatible with fencing in design, material, height and color.  Gate hardware shall be unobtrusive and rust resistant.

2.     The top of the fence shall be parallel to the contour of the ground.  The bottom of the fence shall not be greater than four inches above the grade.

3.     Vertical members shall be plumb.

4.     Fences shall be left to weather naturally or coated with a clear sealant.

5.     Homeowners will maintain fences in good repair. 

6.     Replacement of broken slats or posts must be of the same size and shape as the original. 

7.     Tree removal necessary for the installation of a fence shall be described in the application according to the requirement standard for tree removal.

8.     Owners contemplating tree removal shall do it in compliance with the MoMA Tree Policy outlined in B.3 above.

9.     Natural wood-tone stains or paint shall be considered on a case-by-case basis.

 

G.19.   Flags and Flagpoles

Requirement:

1.     An application is not required for a flag mounted on the dwelling that meets the standards.

2.     A permanent free-standing flagpole is not permitted.

Standards:

1.     No more than one flag may be mounted on the dwelling without an application and approval, unless for a period of less than 30 days prior to an event and 7 days thereafter. 

2.     A flag must not be larger than 6 feet in any dimension.

 

G.20.   Flower Pots and Urns (See G.11, Decorative Objects)

 

G.21.   Gutters

Requirement:

1.     An application and approval is required for replacement of gutters.

2.     Applications shall include samples of the materials identified for use by the contractor.

Standards:

1.     Gutter trough and fasteners must be copper.

2.     Repair or partial replacement of the gutter shall exactly match the color, profile, style, dimension and material, with no visible differentiation between the new and existing gutter. 

 

G.22.   Holiday Decorations and Lighting (See G.11, Decorative Objects)

 

G.23.   Hand-Railings

Requirement:

1.     An application is not required to replace a hand-railing in the same location and of the same size, materials, color and design, provided the standards are met.

2.     An application and approval is required for any new hand-railing or to extend or change an existing hand-railing.

3.     All application and approval is required to permanently remove existing hand-railing.

Standards:

1.     Hand-railing may be constructed of black wrought iron.

2.     Hand-railing style, material and location will be considered on a case-by-case basis.

3.     Hand railings will be painted black.

 

G.24.   House Numbers

Requirement:

1.     An application is not required to replace house numbers in the exact location with the existing style, color, and material compatible with the community architecture.

 

G.25.   Landscaping

Requirement:

1.     An application is not required for landscaping in backyard/enclosed areas and done in compliance with the standards. 

2.     An application and approval is required for garden edging materials and landscaping in areas not enclosed in the homeowner’s fenced-in area.

Standards:

1.     Landscaping should be consistent with community Design Review Guidelines and complement the existing landscaping. 

2.     Consideration should be given to the potential nuisance of certain plantings such as bamboo, weeping willow, mulberry trees, and fruit trees among others.

3.     All garden areas, including fenced areas, must be maintained in good order.

4.     Plastic edging is not permitted.

5.     Plastic items are specifically prohibited.

6.     Ivy and other vines are permitted but must be maintained.  Dead vines must be removed and, growing on a home, the underlying brick must be cleaned and returned to its original state.

7.     Mulch, installed by the homeowner, will be consistent in color and style as mulch installed by the landscaping contractor. 

 

G.26.   Lighting

Requirement:

1.     An application is not required to replace existing exterior and security lighting in the same location and similar in size, color, and design provided the standards are met.

2.     An application and approval is required for all additional fixtures and changes in exterior and security lighting.

Standards:

1.     House-mounted security lighting fixtures shall be considered on a case-by-case basis.

2.     Exterior and security lighting, if allowed, shall be directed so that light intensity has no effect outside the applicant’s property.  Security lighting, if permitted, shall not create a nuisance or hazard shining in the eyes of passersby or individuals operating motor vehicles on adjacent units.

3.     String or individual lighting above ground is considered holiday lighting and will only be installed and illuminated during appropriate holidays. (See G.11 Decorative Objects)

4.     Free standing security lighting is prohibited.

5.     Security lighting fixtures shall not be installed in place of decorative lighting (e.g. as stoop/porch/garage lights)

 

G.27.   Painting

Requirement:

1.     An application is not required for repainting or re-staining to match existing color standards.

2.     An application and approval is required for any change to existing exterior colors.

3.     An application shall include a description of all existing exterior color and a description of the paint or stain properties.

Standards:

1.     Homeowners are responsible for maintaining the paint on the trim, doors (including garage), siding, and other exterior surfaces. 

2.     The color must be identical to the builder’s original color: Benjamin Moore HC-27 Monterey White for light brick homes; Benjamin Moore HC-26 Monroe Bisque for homes with dark brick.

 

G.28.   Roofing

Requirement:

1.     An application is not required to replace the entire roof of a dwelling provided each of the listed below standards are met.

2.     An application and approval is required for a requested variance to the standards for roof replacement, repair, or modification.

Standards:

1.     Roofing material is #1, ½” X 24” Hand-split re-sawn Western Red Cedar, Class “C” Fire treated shakes

2.     Shakes are to be laid approximately 10” weather exposed using stainless steel nails.

3.     Fire treated Western Red Cedar 5.8” X 24” taper-sewn ridge cap laid approximately 10” weather exposure to be installed along the peaks

4.     Ice and water shield will be installed along all eves and all flashing points (e.g., valleys, pluming vent covers, vertical wall intersections and chimneys).

5.     One layer of 36’ 30# felt paper over the entire roof surface.

6.     One 18” layer of 30# felt paper will be woven between shake course.

7.     Flashing will be 16oz copper.

8.     The flat roof must use .060 EPDM rubber.

9.     All cedar siding and trim boards will be cedar.

Considerations:

1.     Coordinate roof replacement with other owners of the units in your building to gain an economy of scale and discounts from the contractor.

2.     Satellite dishes should be re-installed by the contractor.

3.     The contractor shall have insurance to protect personal and property damage.

4.     The contractor shall be bonded.

5.     The contractor shall have a minimum of 10-year warranty on the workmanship.

 

G.29.   Satellite Dishes (See G.2, Antennas, Television/Computer Cabling & Satellite Dishes)

 

G.30.   Security Devices and Outside Speakers

Requirement:

1.     An approved application is not required for any security device or alarm when the exterior alarm control box/keypad (no larger than 6”x4”x2”) and noise generating device are located on the rear of the dwelling; and the system has an automatic deactivation after 15 minutes (or less if zoning codes so specify)

2.     An application and approval is required for all other exterior mounted or exterior sounding devices.

Standard:

1.     Alarm warning signs may be placed in the front yard, and shall not exceed 50 square inches in size and shall be located within three feet of the dwelling walls.  No more than one sign per entry door may be permitted.

 

G.31.   Storage Sheds – Are Not Permitted

 

G.32.   Storm Windows and Skylights

Requirement:

1.     An application and approval is required for installation of storms windows or skylights.

Standards:

1.     Skylights must be installed in the rear of the unit.

 

G.33.   Shutters – Are Not Permitted.

 

G.34.   Walkways (See G.18, Driveways and Walkways)

 

G.35.   Windows and Window Screens

Requirement:

1.     An application and approval is required to replace one or all windows.

Standards:

1.     Windows must meet the style and Design Review Guidelines for size, color, and material for the community

2.     Every attempt shall be made to replace all windows in the dwelling at the same time; however, the owner may replace all windows, or replace all windows on one side of the unit.

3.     Seasonal or other removal of screens shall be uniform for all residence windows.

4.     Any window manufacture will be considered for DRC approval.  Any resident may submit a design, material, color, and working model of a window to the DRC for approval.  Upon a working demonstration of the window mechanism by the manufacturer or sales associate, and a review of the available colors, the DRC will follow the approval process outlined in these Design Review Guidelines. Windows can be purchased from Pella or Andersen that have products that previously have been approved.  The acceptable specifications from Anderson and Pella are as follows:

a.     Renewal by Andersen windows that meet the following criteria:

                                                        i.     Colonial

                                                      ii.     Double Hung

                                                     iii.     Full Divided Light Grilles (3/4 inch dividers - not the 1 1/8 inch option)

                                                     iv.     Screens: full-length screens are preferred and recommended by the DRC.  If half-screens are preferred, the owner must use TruScene

                                                      v.     Color: If your home is constructed with a light brick exterior, then you must use the Andersen Canvas color on the outside. The Canvas color very closely matches the HOA standard of Benjamin Moore HC27. If your home has the dark brick exterior then you'll need to paint the exterior of the window HC-26 Monroe Bisque.

                                                     vi.     Consideration: The interior window color may be different from the exterior color. The owner may order any color for the interior.

b.     Pella windows that meet the following criteria:

                                                        i.     Architect Wood ILT series Double Hung, Equal Split.

                                                      ii.     Grill: ILT No.7/8” Traditional (3W3H/3W3H).

                                                     iii.     It references “General Information: Standard, Luxury Edition, Wood, Pine”

                                                     iv.     Glass: Insulated Low E SunDefense Dual LowE Argon Gas

 

 

H. Maintenance

            Properly maintained lots are important for safety reasons, the visual character and economic value of the property, the surrounding neighborhood, and MoMA as a community.  Each owner and resident is required to maintain his/her property consistent with the MoMA Design Review Guidelines.

 

H.1.     Property Ownership

            Property ownership within MoMA includes the responsibility for maintenance of all structures and grounds that are part of the property.  The owner shall keep all lots owned by him, and all improvement thereon, in good order and repair, free of debris, all in a manner and with such frequency as is consistent with good property management.

 

H.2.     Property Maintenance

            Property maintenance includes preserving the appearance of the property, and repairing or replacing materials that have deteriorated.  Property maintenance includes, but is not limited to, grounds maintenance, disposal of trash and debris, proper maintenance of any structures on the lot, driveway, and walkway to ensure aesthetic appeal.  A few examples of violations of the Design Review Guidelines are:

·      Any surface with peeling or fading chalking, stain, or paint

·      Gutters or downspouts which are bent, dented, sagging, missing, or dirty

·      Driveways, walkways, decks, or porches which are broken or deteriorating

·      Incomplete architectural alterations

·      Inappropriate storage of building materials, lawn equipment, toys, or refuse

·      Fences that are broken, rotted, leaning, or missing

·      Areas void of ground cover, landscaping, or overgrown with weeds

·      Indiscriminate use of herbicides, pesticides, or fertilizers

·      Conditions which can cause or are causing erosion or flooding

·      Dumping of organic debris (i.e., leaves, grass clippings, branches) in a non-approved area, in a common areas or in an open space

·      Shrubs and trees obstructing walks, paths, and streets or that have become overgrown

·      Litter

 

H.3.     Maintenance Planning

            Maintenance planning is the responsibility of all property owners.  There are several maintenance requirements which include, but are not limited to, roof replacement, window replacement, painting, driveway, and walkway repairs that are typically very costly.  Owners should anticipate these repairs and develop a financial plan to make repairs when they become necessary.  Cost of maintenance is not a mitigating factor in relieving an owner of maintenance responsibilities.

 

H.4.     Storage and Use of Trash and Recycling Containers

            Trash shall be stored in appropriate trash containers with the trash container and recycling bins to be stored in the garage on all days other than those scheduled pick-up dates.  For health and aesthetic reasons, trash shall be put out in closed, rodent/animal proof containers by the curb in front of the homeowner’s property no earlier than the evening prior t the schedule pick-up.  Residents are responsible for the contents of plastic bags or cardboard boxes and brush debris that may be spread by vermin and/or weather events.
